According to the Baltimore
Sun, one teen was killed in a crash over the weekend in Hydes while two
others were injured. Owings Mills, MD accident lawyers are trying to ascertain
what exactly happened.
16-year old Kyle Snow was declared dead
on the spot when authorities rushed to the scene of a serious automobile crash
in Bottom Road’s 13200 block at approximately 1 pm on Saturday.
This accident report has not been fully recorded yet. |
WBALTV
sources state that Snow was a resident of Woodlea Avenue’s 4600 block in
Baltimore. According to police, he was a passenger in the back seat of a Dodge
Ram that lost control, collided with a pole, then flipped over, and crashed
into a tree as it was making its way south on Bottom Road.
The 17-year old driver and 16-year old
passenger were both transported to John Hopkins Bayview Medical Center.
Officials say that both teenagers are expected to recover from their injuries. The
16 year old passenger Kyle Snow was the passenger in the back, he is the one
who did not make it.
The crash is being investigated by the
County Police Crash Team of Baltimore and authorities say that it is expected
to take a couple of weeks to look into the matter. Obviously, according to
logic, the driver is most likely at fault. Speeding comes to mind for one. The
driver did not appear to be drunk, so as of now this is not a drunk driving
accident.
Determining
Fault in a Car Crash
Every year, more people are killed in
traffic crashes in Maryland than homicides which says a lot since Baltimore, as
seen in the show The Wire, has a massive amount of murders and the city does
not even care to report them all. More than 90% of the total number of crashes
are preventable accidents that are mainly due to driver negligence. In 2013, 32,719
people succumbed to injuries caused due to vehicle collisions in the state of
Maryland. And, approximately 19,000 people killed in the first half of the year
2015, which is alarming!
In almost all traffic crashes, be it
cars, motorcycles, or bicycles, it is vital to prove who was liable or
responsible for the accident, i.e. who was careless or negligent. The person at fault may be
obvious to everyone but just saying so is usually not enough for insurance
companies. You need evidence to make a stronger argument to your insurance
provider and the other insurance company and this is where an Owings Mills, MD
accident attorney steps in the picture.
Collecting
Evidence
Fault needs to be proven with evidence.
This evidence can consist of police reports, eyewitness testimonies, photographs
of the accident, and so forth. It is critical to make sure that you collect as
much evidence as possible right after your accident. In most cases, it is not
necessary to prove fault beyond any reasonable doubt, but rather should be
shown through evidence that is pretty convincing. Therefore, the standard of
proof is not over the top, which means that allegations of fault are not
required to be indisputable.
Fault
Patterns
In most states, the party that rear
ended the other car is considered responsible or at fault for the accident.
Therefore, a large percentage of fault falls on the last driver involved in an
accident. If there are multiple cars involved, each car that hit another car
from the rear may be found to have some responsibility of fault for the
accident.
