The management of Vail Run Resort has agreed to settle a claim of $1
million made by 8 Mexicans who faced workplace sexual harassment at the hands of a manager.
What is more disturbing is that the manager also fired workers who complained
against the behavior. This is the type of risk you take when you come to
America or any country for that matter illegally. This is why you should come
to America legally.
The resort has agreed to hire the services of a monitor for a span of 5
years to oversee the payment of claim, according to koaa.com.
The Denver Post also claimed that the company has decided to change the
language of their handbook. From now on the handbook will have both English and
Spanish versions. Additionally the managers will undergo training to understand
sexual harassment laws. However, the settlement agreement filed in the federal
court by sexual harassment lawyers on behalf of the victims had no mention of
wrong doing by the company and when the company was contacted for a comment on
the subject no one answered.
University of Tennessee in the Dock
for Violating Sexual Harassment Laws
The University of Tennessee is in serious trouble due to allegations of
six women who filed a lawsuit against the institution. The lawsuit claims that
the university promotes a student culture in which sexual harassment is
allowed. They claim that the university uses a process of mediation that is
clearly biased against those who report the incident, as reported by Tennessean.com.
In the civil suit five Tennessee athletes are named as assaulters. Former
football players Michael Williams, Riyahd Jones, AJ Johnson, former basketball
player Yemi Makanjuola, and another current player mentioned as John Doe are
named as defendants, say sexual harassment attorneys closely following the
case.
The suit details an incident that took place in the Vol Hall during a
football team get together. A girl was assaulted by a non-athlete at this very
party. It also stated that the girl was intoxicated when the assault happened
and that she was served alcohol by UT player Treyvon Paulk.
Be careful where you get drunk at!
The lawsuit claims that the university’s disciplinary systems allow
players to get off scot-free even after they violated the laws under Title IX.
The lawsuit cited multiple incidents of armed robbery, harassment, assault,
underage drinking (which is not a big deal), and sexual harassment perpetrated
by football players. The plaintiffs have asserted that the University has
flouted Title IX laws that protect students from gender discrimination who are
enrolled in programs that are federally funded.
The plaintiffs claim that UT creates a hostile environment for female
students by deliberately showing indifference when an assault is reported. The
plaintiffs considered the responses by UT officials as clearly unreasonable,
thereby forcing the victim to endure added humiliation.
The lawsuit claims that Chancellor Jimmy Cheek, and Athletic Director and
Vice Chancellor David Hart knew about the assaults by the football players but
did not take any corrective measures, which posed serious risks to female
students. Moreover, the players were provided with top notch legal
professionals and they appeared in an evidentiary hearing in front of an
administrative-law judge appointed by the chancellor himself. This made it
evident that the players are fully aware that the UT management is on their
side.
The sexual harassment lawyer engaged by the plaintiffs cited instances
where the administration chose to sit on a complaint until the player is transferred
to another university from where he can graduate without any issues.
Importance of Taking Legal Advice
Consulting a sexual harassment lawyer is pivotal since state laws are not
uniform. Moreover, not all gestures fall under the purview of sexual
harassment. If you are a victim of
sexual harassment at the workplace or university, your legal representative
will analyze the details if there is merit in your claims. He/she will provide
valuable advice on how to deal with management especially when they do not
cooperate and take your sexual harassment case seriously.
The positive news about these explosive cases is that legal help is
around the virtual corner. Go right here: Sexual-Harassment-USAttorneys and you can find a legal counselor you need that can make
