Why is it difficult to determine THC
levels for a DUI Charge?
Law enforcement agencies are still
looking for a perfect way to tell whether a driver is too drugged to drive
safely. The problem with a DUI involving drugs is that there are no legal
limits that can be set for drug use. Years of research have been able to
determine a legal threshold for alcohol induced DUIs. But unlike alcohol, drugs
do not dissolve in water. They are actually fat soluble.
As reported by apr.org, this is the reason why it is
difficult to develop techniques to measure THC levels in a person, and is one
of the common defense strategies that DUI attorneys in Tuscaloosa, Alabama
adopt in order to prove that their clients were potentially not driving under
the influence. According to neurobiologist Margaret Haney of Columbia
University, the absorption in the body happens in a totally different way and
hence mechanisms such as breathalyzer and urine tests are not effective
determinants of THC levels in an individual.
But the police can still have the person
do motor tests on the side of the road and if they fail they fail.
When an individual is drinking, alcohol
spreads through saliva and later saturates the blood and the lungs. So when a
certain amount of alcohol is detected in a person, the alcohol level can
predict how much the brain is affected. Years of research have shown that.08 is
safety limit for drivers. This is not the case for THC as it quickly moves from
the blood to fatty tissues. This means if you take blood samples from a drugged
driver you will detect minimal traces of THC while its presence in the brain
can be alarming.
There will be a device out one day to assist
police in this noble endeavor. It will be invented by someone in the private
sector if the EPA and other federal job killing bureaucracies allow it.
