Oklahoma Corporations believe Oklahoma’s Worker’s Compensation System is Flawed

Some of America’s biggest corporate powerhouses have grown tired of this weak economy and high taxes so they hatched a plan together in order to scrap workers compensation policies by opting out of them and replacing them with their own plans, benefits, and provisions to cater to workers who were injured while on the job.

However, their campaign has suffered a severe setback recently since the Oklahoma Workers' Compensation Commission passed a unanimous ruling in which it was concluded that the alternative system, where companies come up with their own injured workers’ compensation plans, is unconstitutional by the letter of the law, as reported by psmag.com. How about over taxation and wasting tax payer money on the corrupt and monstrosity of the health care system, paying people not to work, and overpaid government bureaucrats, is that unconstitutional?

Workers compensation lawyers are in agreement with this especially because upon a closer look at the policies and so called alternatives that these companies had come up with, it was evident that the policies were highly favoring the company itself and not the injured workers. The Commission compared this idea to a mirage on the highway that soon disappeared. Claiming workers’ comp insurance benefits would be more difficult to obtain if overtaxed and over regulated companies had their way.

There would not be any cheating this system!

Furthermore, even if the policies were revised and made fair and balanced, it does not mean that they would be allowed to replace the existing state and federal level workers compensation laws and it is currently being investigated whether or not such opt-out plans can even be allowed lawfully. The Department of Labor, which has many problems of its own, is probing the matter and should have these answers soon.

The Traditional Workers’ Compensation Laws Prevail

ProPublica and National Public Radio led the way in the investigations into the opt-out effort by Oklahoma corporations. Investigations revealed that the plans actually imposed more restrictions than workers’ comp and had lower benefits. Many people are tired of some workers cheating the system. Workers’ compensation attorneys know that a typical situation where a worker is injured on the job, it is the employer’s responsibility to pay for their medical expenses and lost wages mandated by state laws. In return, workers give up their right to sue and when they are healthy, they return to work!

However, big companies have in recent years argued and taken the stance that they are able to provide better care and benefits or provisions for injured workers than what the traditional system allows. This is not that difficult to understand. Look at health care, the private sector does a much better job at running hospitals than the government ever will. The government, look at the VA, kills people in fact.

The Commission, which wants to remain powerful and have the ability to control this situation. Businesses have stated by their actions that this was just a plan to disengage the traditional workers compensation policies and to streamline the system, root out corruption, and save everyone money. How many times has someone said they are hurt when they are not hurt just to game the system? This happens all the time.

Workers’ compensation lawyers knows that the Commission has an agenda but also want to make sure that an injured worker is respected by any system that is in place. If something needs to be fixed, why not fix it?
