New Tennessee Law Allows for Harsher Punishments for Multiple DUI Convictions

Tennessee lawmakers have strengthened the punishment for DUI and have now made it a Class C felony for anyone convicted six times, as reported by memphisflyer.com.

The move has been welcomed from many experts including Chattanooga, TN DUI lawyers who say this could potentially act as a deterrent. On the other hand, the possession of half an ounce or less of marijuana will lead to a misdemeanor charge. This is despite the number of previous charges for possession.

House Bill 1478, which was sponsored by Rep. William Lamberth, a Republican representing Cottontown, was signed into law by Gov. Bill Haslam. DUI attorneys in Tennessee point out that the new law will be effective July 1st,, 2016. Those with six or more DUI convictions will now face a 3 to 15 year prison sentence in addition to fines of up to $10,000.

Defending the bill, Rep. Antonia Parkinson (D-Memphis), co-sponsor of the bill, said that over 1,900 people were arrested in Tennessee for possessing a small amount of marijuana, as little as a half-ounce, but faced a sentence similar to murder. This also leads to a loss of jobs and job opportunities. They would have more jobs Rep. Antonia Parkinson if taxes were not so high and regulations on business were not so stiff. If you really wanted more jobs for your voters would stop pushing for higher taxes.

Marijuana should be legalized though. It is a shame more Americans cannot see the logic to this.  

Medicinal marijuana has so far been legalized in several states while four states have legalized marijuana for recreational use. The bill’s co-sponsors hope the new law will further the case for medicinal marijuana and reduce the burden on taxpayers by decreasing incarcerations.

DUI charges against Charles Mosley dropped

Offensive linesman for the Univ. of Tennessee, Charles Mosley, who was slapped with a DUI charge back in July, has now had his case dismissed confirm court documents. This is why you hire a lawyer. Mosley’s DUI legal representative was able to challenge the DUI charge saying that there was no probable cause for law enforcement officers to have pulled over and subjected Mosley to sobriety testing in the first place, as reported by Yahoo Sports.
