South Florida cardiologist, Eric Spivack
of Sunny Isles Beach, has been arrested in connection with a fatal DUI crash in
August 2014 that led to the death of a pedestrian. As reported by local10.com, he has been charged
with DUI manslaughter stemming from the accident that occurred on
Northeast 163rd Street.
Spivack struck and killed 77 year old
Yakov Duboshinskiy who was crossing the street at Northeast 35th Avenue.
Police reports indicate that the defendant’s eyes were bloodshot and they also
smelled the odor of alcohol on his breath. Toxicology tests indicated that the
cardiologist’s blood alcohol concentration or BAC level was .087, which is just
over the legal limit according to Fort Lauderdale, FL DUI lawyers.

Following the arrest warrant, the doctor
was arrested at his workplace at Aventura Hospital. Bail was set at $30,000 and
the judge has also ordered that he wear a GPS monitoring device on release in
addition to the installation of an ignition interlock device on his car.
Now this doctor can be a doctor in
prison. Like House was! And what House did was almost just as bad.

Wftv.com reports that 45 year old Krystyna
Vitiello has been released on bail after being arrested on a boating under the
influence charge. The charge stemmed from a motorboat accident that crashed
into a dock on Lake Maitland. The impact of the crash injured three of the
eight people on board according to the Florida Fish and Wildlife Conservation
Commission. The accident happed in the wee hours of the morning near Columbia
Drive and Summerland Avenue.

drive a boat drunk! Krystyna Vitiello must have been almost blinded drunk, she
put the boat on top of the pier.
Vitiello is said to be Florida Sen.
David Simmons’ ex-sister-in-law. Incidentally, the senator’s 18 year old
daughter was a passenger on the boat and was celebrating her boyfriend’s
birthday. The teenager was sustained a broken femur and was operated on. Not a
fun time! Birthdays are overrated anyhow.
Police reports indicate that Vitiello
asked for a Florida DUI attorney to be present when questioned if she was
operating the boat. However, she alleged that several people operated the boat –
but you were the one who crashed it! Right Krystyna?! She also refused to
submit to a blood test. Three of the passengers were rushed to hospital,
including the senator’s teenage daughter with serious injuries as already
stated. However, they are said to be out of danger.
According to Fort Lauderdale, FL DUI
lawyers, the civil penalties for refusing to submit to blood tests is $500
fine. The criminal penalties for boating under the influence with a BAC of .08%
or more includes a $1,000 fine, jail time up to 6 months, and probation up to 1
year, along with other punishments such as community service.
Incidentally, sun-sentinel.com reports that Sen. David
Simmons (R-Altamonte Springs) introduced a bill at the end of last year to
increase the fine for refusing a blood test from $500 to $1,000 in addition to
6 months’ probation and a loss of four points on their driver’s license. The
bill also states that judges be not allowed to suspend or withhold any of the
penalties.
Well Simmons is not married to that
family any more so he is good to go. Certainly he is worried about his daughter though.
