10 Year Old Las Vegas Girl and Grandmother Killed in a DUI Crash near Fresno, CA

(Fresno, CA) – April 11th, 2016 – A Las Vegas family on their way back from Yosemite National Park was unfortunate to get into a deadly accident that took the life of a 10 year old girl and her 69 year old grandmother. As reported by news3lv.com, the cause of the accident is said to be due to drunk driving. The accident occurred just outside of Fresno, CA.

Reports indicate that the Espinosa family was driving back from the park when they were t-boned by 25 year old Cheyenne Wyllie’s car. The two victims were Jaime Espinosa, 10, and Angelita, her 69 year old grandmother. Both died in the crash.

According to Fresno, CA accident lawyers, Wyllie is likely to face DUI vehicular manslaughter with gross negligence charges that attracts a sentence of up to 10 years in jail. Depending on the circumstances, anyone charged with DUI manslaughter can also be charged with second degree murder, which will lead to up to 15 years to life in prison.

George Espinosa is now fighting for his life in an ICU. Ironically, he is an intensive care unit nurse at Sunrise Hospital. One of his colleagues, Veronica Hill, a nurse, said that he has been a phenomenal nurse who never left a patient’s side when in need. Unfortunately, due to Wyllie’s irresponsible conduct, George’s wife Charlotte, is now at her husband’s side in the ICU and has lost a daughter and mother-in-law.

Pouring salt on the Espinosa family’s wounds is the fact that Wyllie’s BAC almost three times the legal limit at .22%, but she was set free on bail the very next day after the fatal DUI accident. According to standout accident attorneys in California, the defendant’s BAC will play a major role in determining the actual sentencing and potentially the amount of compensation the victim’s family will receive for their accident claim.

25 Year Old Fresno State Student Dies in a Motorcycle Accident

Yourcentralvalley.com reports that a Fresno State student was killed in a solo motorcycle crash just north of Bullard between Chestnut and Cedar. His body was discovered by joggers around 6 am right next to a motorcycle.

The victim has been identified as Joel Talbot, 25, who according to initial investigations by Fresno State Police may have been travelling eastbound and hit a pipe head on. Talbot was said to have been wearing a protective clothing. However, this failed to protect him. Investigations into the accident are ongoing. Talbot was studying crop science production at Fresno State, and was also recently employed at Fresno State Farm’s Orchard enterprise.

This is a terrible accident and it seems he just did not see the pipe. This was not an area for motorcycles and signs were posted.

California Personal Injury Laws

According to Fresno, CA accident lawyers, the statute of limitations within which a personal injury case must be filed in the state is two years. The state has implied the shared fault law where all those involved share liability depending on the percentage of fault they are found to be at following an auto accident. For the most part the state follows the ‘pure comparative negligence’ rule where the amount of compensation you may be entitled to receive is reduced by the amount equal to your percentage of fault in the accident. So if you are found to be 20% at fault in the accident and your claim is $10,000, then your compensation will be reduced by $2,000.

If you have suffered injuries in a car accident, make sure to consult a California accident lawyer. Your legal professional will evaluate your case and make sure your rights are protected and you receive the compensation that you rightly deserve.
