Drunk Off-duty Firefighter Kills Teenager in DUI Accident

Warren firefighter Tad Dennis had a minimum of 10 drinks during his golf outing on Sept. 11th last year. He then visited Clinton Township Restaurant where he had another 88 ounces of beer before he hit the streets in his Ford Escape. Was he trying to escape (pun intended) reality?

Dennis was unable to control his SUV later and slammed his vehicle into a car driven by 17 year old Diana Pozderca, resident of Sterling Heights. She died within an hour. Dennis, firefighters are supposed to save lives, not take them. Well, you are no longer a fire fighter so that is that.

As reported by Detroit Free Press, the 13 page complaint sheet describes the harrowing last minutes of the girl. A witness who used a fire extinguisher to douse the flames that engulfed the vehicle said that her head was on the dashboard of the car and she looked up at the witness pleading for help. She said she cannot feel her legs.

43 year old Dennis faces a number of criminal charges including DUI and second degree murder. Dennis was also gravely injured in the accident and his BAC was .21%, which is far over the state’s legal limit according to Warren, MI accident lawyers.

Pozderca’s father has filed a civil lawsuit against Maple Lane Golf Club, Dennis and Bearcat Enterprises Ltd. who runs the Clinton Township Restaurant with the assistance of accident attorneys in Michigan. The lawsuit contains three counts and the girl’s father is claiming $1 million for each count respectively. Dean Kallas, representative of Bearcat Enterprises, said in a statement that the investigation conducted at the Clinton Township Restaurant showed that the allegations have no merit. He did not give any details but said that he will ask the court to dismiss his client.

Millions of dollars? Not very many people or businesses can afford that.

According to Warren, MI accident attorneys, the girl’s estate is able to name Bearcat Enterprises as a defendant based on the state’s dram shop law which is in force.

Places that serve alcohol should start testing people if they are too drunk to order any more drinks. Is that what Bearcat Enterprises should have done?

Charges against Maple Lane Golf Club

Dennis was playing golf for Warren Firefighter’s Benefit organized on the occasion of September 11th. This was the terrible terrorist event on the WTC towers that was caused because Al Qaeda was not handled in the 90s and because of political correctness. There are memorials around the country because of this day and tragedy.

The club issued drink tickets that the participants could exchange for drinks. Additionally the club also provided two alcohol carts as well as bars from where beverages can be purchased. Dennis exhausted his tickets and then bought alcohol from the carts.

According to witnesses he had a total of 10 drinks. The complaint states that Dennis was served beverages from 3 pm to 6:36 pm in spite of the fact that he was visibly inebriated.

Should someone have taken his car keys even if physical manhandling would be required?

Dennis left the club at 6:38 pm with two men and showed up at Buffalo Wild Wings half an hour later, which is located 15 miles away. Good thing he did not get into an accident before he arrived here. He was drunk enough!

There he had four 22-ounce beers. Witnesses say that he spilled one of the drinks on a companion but failed to realize that he had spilled it. How come this companion did not take Dennis’s car keys from him?

He left the restaurant at 8:28 pm and just fourteen minutes into the ride ploughed his car into the 2001 Mercury sable driven by the teen. He was driving at 79 to 81 mph which is twice the permitted speed limit in that area.

For the most part, the laws related to DUI and dram shop cases change frequently. In addition, if you are injured in a car accident, this could involve a number of critical legal procedures such as gathering evidence, witnesses, and negotiating an accident claim. Then again there could always be issues such as bad faith lawsuits and underinsured or uninsured claims. This makes it essential to contact a Michigan accident lawyer as soon as possible.

Dennis made a colossal mistake. It looks like more than one. Why anyone would want to drink that much alcohol, only drunks have an answer to this. What is the cost for all of that? Well, it is apparently a human life. Accident.USAttorneys.com – this is where you want to go if someone hits you, drunk or not.
