Former Chicago Doctor Settles Medical Malpractice Suit for $30 Million

The estate of a 6 year old boy has settled their lawsuit against Dr. Mark Holterman for nearly $30 million in a medical malpractice case that stems from the boy becoming brain dead after repeated brain surgeries being performed on him by Holterman. According to the Chicago medical malpractice lawyer representing the family of the boy, Holterman allegedly performed experimental surgeries on the boy like he was some sort guinea pig, as reported by the Chicago Tribune.

In the lawsuit the plaintiffs claim that a staggering 25 surgeries were performed on the boy and the 25th one executed back in 2011 left the little boy with irreversible cerebral palsy. Did the parents ever try to obtain another opinion before this type of hospital neglect became worse?

Holterman has refrained from making any comments about the case and did not respond to several phone calls seeking comment. He was a teaching doctor who was on the faculty of University of Illinois in Chicago and in another Chicago based hospital, Rush University Medical Center.
A previous lawsuit also relating to the same case was filed by the boy’s mother against Rush University Medical Center while the boy was still under the care of Holterman says the family’s Chicago medical malpractice attorney.

Even though Holterman himself refrained from making any comments, Rush University did release a comment in which they claimed to have been deeply saddened by what had transpired and that they take exceptional pride in providing the best medical care to their patients. Rush: Boy will require lifelong care

Rush denied that Holterman performed any experimental surgeries on the boy and were quick to his defense by calling him a skilled and experienced professional. They also said that he was not removed or terminated from Rush, but instead had himself chosen to pursue other career opportunities elsewhere.

Legal representatives closely following the case say the $30 million settlement will be the fourth largest medical malpractice settlement involving a child in the state of Illinois.

The families’ legal counselor alleges that the boy was born with non-life threatening medical complications in November of 2009. Well could anyone have done any better? Why did the parents continue to use Rush as their doctor?

A latest report by the Chicago Tribune suggests that the University of Illinois will pay $10 million of the settlement while Rush will pay $20 million towards the settlement of this medical malpractice claim.
