Tampa City Chooses to Fight $18 Million Verdict more than a Decade Later

Biker Ramiro Campanioni Jr. was injured in a deadly crash with a water department truck that almost took his life 20 years back. He was ripped apart from his waist down due to the impact and had to be given 300 units of blood. He remained in an induced coma for a month during which time he lost his large intestine, most of his liver and his spleen, according to a tampabay.com report.

Of the $18 million awarded by the jury he received $100,000 back in 2004. According to Tallahassee, FL truck accident lawyers following the case this was the largest personal injury verdict against City Hall. The $100,000 was in accordance with the cap on negligence claims against civic authorities mandate by state law. But if you go by Florida state laws, only the legislature has the power to authorize remaining claim amounts. Claim bills must be placed in the legislature for approval and then the mayor must sign it in order to validate the authorization.

Truck accident attorneys in north Florida say that in accordance with the state laws Campanioni has filed several claims bills to the legislature to grant him the remainder of the amount but these claims have been denied categorically. Furthermore, the mayor made it clear that he has no intention of allowing the claim and he believes that the jury verdict was totally wrong.

George Meros, who is the legal representative for Tampa City, said that Campanioni is a threat to himself as well as to others and giving him money will only jeopardize the safety of the public. In order to prove his point Meros has unleashed a vicious campaign of digging dirt against Campanioni. Past tickets for speeding, DUI, a domestic violence case against him brought by his wife, shoplifting allegations and testimonials from people who claimed he had issued threats against them are all used by Meros to establish why his truck accident claim should be denied.

Campanioni himself says that all these allegations are true but his troubled behavior is not a direct result of what transpired on that fateful day. Does this matter though? Why give so much money to someone who has poor character? But Campanioni should receive some money though if the wreck was not his fault right?

His lawyer Lance Block said that all these past incidents are used as subterfuges against him and the legislature must not focus on them.
