Faribault City Workers Compensation Policy Under Question in Lawsuit

The plaintiff in the case has been identified as Lisa Petricka, a former law enforcement officer who was terminated. In the lawsuit, she alleges that she was not paid or compensated for an on duty injury that she suffered. Furthermore, she also makes allegations about being mistreated post her firing from her department when she raised her voice and tried to stand up for herself about her compensation, as reported by southernminn.com.

Well did she have a temper tantrum in the middle of the office in the middle of the working day? That is not going to work!

As per the allegations in the legal complaint, Petricka was inflicted with a workplace injury in September 2013 and consequently filed a workers’ compensation claim. The lawsuit has not yet actually been filed against the city as Petricka and her worker’s compensation lawyer await the completion of the arbitration process.

As of now, the drafted lawsuit alleges that despite the workers’ compensation policies in the city mandating that injured workers were paid through workers’ compensation and their regular work income in approximately the net pay that the worker earned while on vacation and sick leave would continue as per standard company policies, this is not what happened in the case of Petricka at all.


Revision in City Workers’ Compensation Police came a Month after Worker was Injured

The paychecks that were handed to her did not comply by these standards and the amounts on these checks were nowhere close to the compensation plus Petricka’s normal wages. When questioned, Petricka was told that the workers compensation policy was revised in November 2013 where an injured worker would have to use accrued paid time off to supplement the workers’ compensation instead of being provided with the difference from the city itself and so Petricka would continue to be compensated under this plan.

However, there was one problem, the policy was introduced in November yet Petricka’s injury causing work incident occurred in September. Her worker’s compensation attorney is of the opinion that technically she falls under the policy that existed prior to the amendment and should continue to be compensated in that plan.

The lawsuit also accused the city officers of retaliation where they questioned Petricka about her workers’ compensation claim and then gave her an unfounded poor performance review when she expressed that she intended to pursue litigation to settle the workers compensation issue. Her worker’s compensation lawyer says that this is direct evidence of retaliation and the lawsuit will seek compensatory damages for this too.

It now looks like she finally has something to really panic about after she was found out and sentenced to six month imprisonment and instructed to pay retribution too.
