NY Divorce Laws
According to Monroe County, NY divorce
attorneys, the state permits ‘fault’ grounds and ‘no fault’ grounds for a
divorce. As far as a divorce on fault grounds is concerned, a
spouse can claim that the other partner indulged in some form of misconduct or
rash behavior, which cannot be tolerated any more. Fault grounds as per New
York divorce laws include:
- Inhuman or cruel form of treatment
- Uncontrollable rage leading to physical as well as mental abuse
- Imprisonment for three or more years
- Adultery
However, these grounds will not impact
an ‘at-fault divorce’ case over division of property or alimony.
In a ‘no-fault’ divorce, a spouse does
not have to prove that the other spouse is to blame and can cite irrevocable or
irreconcilable differences of opinion as a reason.
Meanwhile, if there seems to be a difference
of opinion in terms of alimony, child custody or any other matter that is
potentially hampering the termination of your marriage, all you need
is to reach out to a divorce lawyer in New York. This is not a solo
performance. You need outside help.
