Blatant Civil Rights Violation - Victims Face Disciplinary Action for Reporting Sexual Assault

The Education Department has been receiving an alarming number of complaints from distraught guardians of students against several prominent K12 schools. Most of these complaints claim that the students had been punished because they reported incidences of sexual harassment on campus. For the most part, the disciplinary action against the students is construed as a civil rights violation by their parents, as reported by The Washington Post.

No Responsibility in America’s Schools

It is unfortunate that at a time when the national debate on sexual harassment is trying to create awareness among the young generation, some children continue to get punished for raising their voice against the crime while Washington State sexual harassment lawyers remain helpless in some cases. The problem arises when a victim reports the assault or harassment to the politically correct school management who do not believe in punishment.

The authorities in some cases tend to ignore the assault angle and assume that the sex was consensual. Since sexual activity in the premises is illegal the victim is punished for the act and Washington sexual harassment lawyers and dumbfounded by this.

Increasing Reports of Sexual Violence have Rattled the Education Department

Incidents of sexual violence have spiked in colleges as well as in K12 schools. Unfortunately, the Education Department has received various complaints that the schools have not been handling sexual harassment cases properly. What do they expect? School districts across America are defined by political correctness and by people who only care about their retirement package.

Education Department Leadership needs to be Replaced

Catherine Lhamon, the assistant secretary for civil rights in the Education Department, said that she found it retrograde how schools end up punishing the victims when the matter should have been handled more delicately. Washington State sexual harassment attorneys are appalled at this. She pointed out a case from 2010 where a 17 year old student from Texas alleged that she had been raped by a fellow student in the band room.

The Education Department has a boss named President Obama. He is too busy ignoring Christian genocide in the Middle East, defending people in America who do not share American values, raising taxes, spending money America does not have, playing golf, and so on to do anything about this. The problems of America will continue until America has a President who cares and who is not politically correct.

American Schools Defined by Political Correctness

The investigation conducted by the police concluded that the girl participated in the sexual activity willingly and the school authorities believing the police punished both the victim and the assaulter by transferring them to the same school.

Lhamon said that the girl was forced to share the premises with her assaulter and encountered him almost every day. Lhamon’s office investigated the case and in 2012 found that the Henderson Independent School District was guilty of violating the victim’s Title IX rights. The school was made to sign a resolution agreement to ensure that it will implement proper policies to address sexual harassment and assault. The district expunged the girl’s discipline record.

Cari Simon, a Washington lawyer, believes that the school district must have some type of amnesty programs which can protect students who have reported incidents of harassment. Other people believe that anyone who violently rapes someone else should be in prison for 20 years or more depending on the circumstances.

The Goodman Case

Dea Goodman’s daughter was expelled from school after she reported an incident of sexual harassment as the school authorities believed the attacker’s version of the events.

Goodman’s daughter was called to the office of Cousino High where she was questioned about a rumor that she was found having sex in the parking lot of the school in May 2015. She claimed the boy had forced her to have sex with him in the car and she was coaxed to oblige him as he had locked the doors of the vehicle.

The boy on the contrary claimed that the sex was consensual and they had planned it together. The police also found a sex video clip in the boy’s phone. The girl was expelled as the boy’s version was taken as the truth. Perhaps it was.

Sexual harassment in schools is a regular occurrence and since statistics show that schools often punish victims, it would be prudent to consult a Washington State sexual harassment lawyer (sexual-harassment-lawyers.usattorneys.com/washington) should you or anyone you know happen to be a victim of sexual harassment. This will help hold the school responsible and prevent them from pinning the blame on the victim – you!
