The plaintiff in the case is the
mourning father of a Bloomington woman that died as a result of someone else’s
bad decision to get behind the wheel after having had one too many alcoholic
beverages. The drunk driving accident occurred back 2012
which claimed the life of 21 year old Lauren Leffler, as reported by pantagraph.com.
The defendant listed in the case has
been identified as 27 year old Katie Lawson. Lawson’s car struck Leffler while
the latter was attempting to cross the road with a friend. The accident took
place at Washington and Main streets in downtown Bloomington. The judge
overseeing the case has sentenced Lawson to 12 years in prison after finding
her guilty of the crime of aggravated driving under the influence of alcohol,
which is a common sentence in such cases which drunk driving accident lawyers
have been on both sides of the fence on in their day.
12 years may not be enough but at least
it is something.
Drunk
driving accident lawsuit comes to a settlement
The lawsuit was filed by Leffler’s
father in 2014. In the lawsuit, the plaintiff’s drunk driving accident attorney
not only claimed Lawson was negligent in causing the accident but also pointed
a finger at Lawson’s mother who let Lawson driver her car being fully aware
that Lawson had an extensive history of drunk driving related offenses.
The plaintiff’s drunk driving accident
lawyer revealed in a media interview that they had reached a settlement
agreement in the lawsuit where all counts against Jamie Barker (Lawson’s
mother) will be dropped and all counts against Lawson (with the exception of
those related to wrongful death) will be dropped too.
The settlement amount was not disclosed.
Lawson has gone ahead and filed a clemency
petition wherein she asks the State’s Prisoner Review Board to factor in the
claim that she has an auto immune disorder which cannot be treated properly in
prison and which is also a serious medical condition that can be life
threatening if not treated properly. Many other people believe so what. She
should have thought of that before she drunk and drive and appears like she
liked to drive drunk all the time.
Katie Lawson already killed one person,
why should she ever be trusted again? In a democracy, trust is critical and
what has Katie done to prove to society she does not deserve to be in prison?
Clemency? Her sentence should be about 20 years anyway before clemency is even
contemplated.

ERISA
case – Supreme Court rules in favor of drunk driving victim
In an 8-1 decision, the Supreme Court
passed a ruling which employers weren’t pleased with when they declared that an
accident
victim that collects damages in a third party settlement can breach
the agreement to repay employer provided health insurance benefits. But
employers can cover themselves if they file a suit quickly. In this case, they
waited six months to file a suit to be recompensed. The employers or the health
plan took too long to file the suit.
The one person that voted against the
decision has been identified as Justice Ruth Bader Ginsburg who is of the opinion
that accident victim, Robert Montanile, is able to unfairly escape his
responsibility to reimburse his employers because of this absurd decision of
the Supreme Court.
If you or someone you know is a victim
