Money is often the main bone of
contention in a divorce, and a wealthy socialite has certainly made this clear.
According to the New York Post, Tracey Hejailan-Amon has
requested a Manhattan judge to transfer her divorce from Monaco to New York.
Tracey Hejailan-Amon is saying show me the money! Other people are saying Maurice Alain Amon you should have never married her, certainly not without a pre-nup! |
The main reason behind this move is the
potential risk of her losing $70 million in gifts from her estranged husband,
Maurice Alain Amon, a Swiss businessman. Devoted divorce lawyers in Binghamton,
NY explain that according to Monaco divorce laws, a spouse is permitted to take
back any gifts presented to the other spouse during the marriage.
The couple was married for 8 years
before deciding to split. Hejailan-Amon’s $70 million interests include various
assets and property such as $25 million art collection, jewelry, furnishings,
and a fleet of cars. Also at stake is a $15 million Fifth Avenue apartment. For
the most part, Hejailan-Amon would potentially be able to retain those gifts if
her case was moved to New York.
This is due to the state’s equitable
distribution law, according to divorce attorneys in Broome County, NY.
Incidentally, she isn’t a state tax payer, does not vote, and does not even
have a driver’s license issued in New York. Yet, she still seeks to benefit
from the state’s law. That is worse than what Hillary Clinton did when she
chose to move to New York and become a senator.
In a recent Manhattan Supreme Court
hearing at the Manhattan Supreme Court Hejailan-Amon’s divorce legal counselor
argued that his client frequently visited the Fifth Avenue apartment and could
therefore be deemed as her legal residence. Not surprisingly, the Swiss
businessman’s lawyer termed her a ‘gold digger’ and alleged that she also
sought a monthly alimony of $235,000.
A ruling is likely on the matter in the
next two months. Amon’s legal pro was of the opinion that his client could lose
as much as $100 million more as compared to a Monaco court if the judge rules
in favor of Hejailan-Amon.

New
York’s equitable distribution law
Meanwhile, Binghamton, NY divorce
lawyers reiterate that the state’s equitable distribution law does not mean
that property and assets will be divided equally among divorcing couples. In
any disputed
divorce the court will divide marital property fairly.
Divorce attorneys in Broome County, NY say you may need a pre-nup. |
Some of the factors that could influence
the court’s decision include the duration of the marriage, each spouse’s income
and property at the time of marriage and when they filed for divorce, each
parent’s need when children are involved, spouses age and health, and other
relevant factors such as health insurance, pension, and inheritance rights.
In addition, the court is likely to
consider the amount of alimony awarded, the liquidity of all marital property,
the probable financial situation of each spouse in the future, tax
consequences, and more. And we know New York is a high tax state which is why its
economy is pathetic.
Meanwhile, if you need to know more
about equitable distribution or help
with alimony or child support issues, all you need is to reach out
to a Binghamton, New York divorce lawyer. This is the best way to protect your
rights and make sure you receive a fair settlement.
