As reported by newser.com, the family was heading to the airport when an alleged drunk driver collided with their minivan. Ryan Bragazzi and his fiancé, Jessica, were all set for a Disney vacation along with their two daughters aged 7 and 5, when a speeding vehicle smashed into the minivan.

54 year old Doyle Carmack from Aurora is the latest to escape jail time despite being recently busted for his sixth DUI. According to westword.com, his blood alcohol content or BAC registered a whopping .235% following his arrest, which is four time the legal limit in the state, say DUI lawyers in Colorado. Carmack was previously convicted for a DUI on five occasions in Missouri.

Governor John Hickenlooper had only last year signed a bill that made DUIs a class 4 felony in situations where the driver had three prior DUI convictions and a BAC of 0.15%. Incidentally, Carmack fitted the bill perfectly but was only sentenced to 75 hours community service and five years of probation despite the prosecution requesting for four years in community-corrections.

Well, he is giving society back 75 hours of his time but it should have been 200 hours accompanied by a $10,000 fine according to some.

Colorado DUI lawyers explain that this is because of the state legislature’s failure to introduce a mandatory-minimum requirement in the felony DUI bill.

18th Judicial District DA George Brauchler that the state was among the last to introduce a felony DUI. Prior laws mandated that first time DUI offenders with a BAC of more than .20% face jail time of at least 10 days. Those with 3 more DUIs were likely to face at least a 60-day jail sentence.

Brauchler believes that the state messed up when it came to making the provisions consistent with other parts of sentencing under DUI laws. Therefore, under the current law, Carmack was able to escape jail time and only obtain probation. But he did receive 75 hours of community service. Yes, he should have been fined.
