Woman from Streator Charged with Fatal Crash

A Streator woman faces felony aggravated drunk driving charges in the death of a physician killed in a traffic crash near Dwight. She will need a drunk driving accident lawyer.

53-year old Denise R. Woodring has been charged with reckless homicide. The accused has also been charged with aggravated DUI and driving under the influence of cocaine. Woodring requires $50,000 cash to be released on bond from Livingston County Jail. A public defender was appointed to represent her at her first court hearing. Her next hearing is on April 13th.

Woodring caused a crash that led to the death of Dr. Riyaz Nomani, a cardiologist emanating from Naperville who joined Streator’s OSF HeartCare Midwest team early this year. According to a statement by the VP of the OSF Cardiovascular Service Line, Shawn Wagner, Dr. Nomani was a stellar doctor and well established in the community where he served patients for many years. As if America had enough doctors. The ACA and other regulations push people from entering medicine and now drunk drivers are killing people who are already doctors.

The Illinois State Police said that Woodring was traveling in her 2006 Chevrolet Equinox west on Illinois 17 near East 1900 Road when the vehicle crossed the center lane and struck Nomani’s 2007 BMW 525XL.

According to IPS reports, Woodring's Chevrolet overturned and rested in the westbound lane, while Nomani's vehicle ended up in a ditch on the south side of the road. Police said that the accident caused both cars to be totaled and drunk driving accident lawyers will be involved in this lethal crash.

The Times reported that Woodring was first taken to Morris Hospital to treat her injuries, before she was sent to the jail in Pontiac. Attorney Seth Uphoff noted that Woodring also has a DUI case registered in her name in the year 1992.

In the United States, there are almost 36 deaths every day caused by motor vehicle crashes that involve an alcohol-impaired driver. This means that are three deaths for about every two hours that goes by. The nation’s annual cost of crashes that are alcohol-related totals about $37 billion. In 2010, more than 1.4 million drivers were arrested for driving under the influence of alcohol or narcotics.

Drunk Driving Laws

Typically, a DUI conviction can result in rather hefty fines and a criminal record, and in some cases, even jail time. Accident caused by drunk driving often lead to serious injury or death to the driver, co-passengers, and other motorists. Many state laws allow for a felony DUI charge in cases where bodily harm or death of a driver is caused by the alcohol-related acts of another.

Even though a drunk driver may have injured you, no-fault laws in certain states allow for a certain lenience. These laws require a certain threshold be met in order to file a lawsuit. If your damages are minor injuries or limited to your mode of transportation, you will have to file a claim with your own insurance company. Laws vary from state to state, and hence a consultation with a drunk driving accident attorney will help you understand the legalities involved.

Drunk Driving Accidents and Probable Cause

The lower threshold for "reasonable suspicion" that a law may have been broken can be met by simply being in an accident. This allows a police officer to stop and detain the motorists involved temporarily for further investigation.

After investigating, if the officer concludes that a driver is most likely under the influence of alcohol or drugs, which is often based on BAC test results, the officer has "probable cause" to arrest the driver for drunk driving.

Therefore, an officer may be given reasonable suspicion in an accident to investigate the scene, but the officer has probable cause for a DUI arrest only when there is solid evidence of intoxication. However, in some states, a mandatory or discretionary on the spot BAC testing is allowed for drivers involved in accidents that cause serious injury and/or death.
