Another Democrat thinking woman are only
sexual objects. How old is this story?
On the witness stand, former Mayor Bob
Filner maintained that he had not sexually harassed anyone while he led San
Diego into more spending and higher taxes on businesses to pay more people not
to work. He also said that he could not remember an encounter with a woman who
alleges in her lawsuit that he put her in a chokehold.
When he was questioned in San Diego
County Superior Court by a legal counselor representing city employee Stacy McKenzie,
Filner said that he could not recall putting her in a chokehold in April 2013
or even meeting her. He also said that he did not stand behind McKenzie during
the encounter or press his body against hers and brush her breast with his
elbow. Los
Angeles Times reported that Filner said he could not recall the incident
and that there are certain things he would never do. Sexual harassment lawyers
have heard that story before.
When Filner was questioned by the legal
professional at his trial, he was quick with his defense and denied
all allegations. His statements came on the second day of his trial.
A former 10-term congressman, 73-year
old Filner resigned as mayor in August 2013 after there were accusations from
several women of him touching them inappropriately or making unwanted sexual
comments. This is what Democrats do! On top of raising our taxes to pay for
shovel ready jobs they say they have lined up but do not. To pay for peoples’
rent and food discouraging them from finding a job – this is what Filner and
his ilk do. They do not support the military, want to pay for new weapon
systems, advocate pulling out of Europe, favor securing the southern border,
support the police, and so on.
In December 2013, McKenzie, an employee
of the parks and recreation department for 35 years, filed a lawsuit against Filner and the
city, claiming sexual battery and sexual harassment, among other allegations.
McKenzie’s is the first lawsuit to go to
trial. Five other lawsuits have settled while one is pending. Men like Filner
believe they are above the law. They do not realize websites like this Sexual-Harassment-USAttorneys exist which make it
easier for people to find legal help to fight against the monsters that work in
our offices and who share the same streets as we do.
Having served a little less than a year
as the mayor, Filner pleaded guilty of having manhandled a woman at a
fundraising event in March 2013 by putting her in what an embarrassing
situation which became known as "the Filner headlock." What?! There
were two other misdemeanor battery charges that he also pleaded guilty to – one
for kissing a woman without her consent at a "Meet the Mayor" event
that was held at the City Hall and second for grabbing a woman's buttocks at a
Fiesta Island cleanup campaign.
McKenzie was not identified as one of
the victims in those charges.
Filner was asked several questions by
Manuel Corrales Jr., McKenzie’s sexual harassment lawyer, about accusations of
inappropriate behavior with his executive assistant and communications director
while he was in office.
Jurors were told by Superior Court Judge
Timothy Taylor that they could consider the former mayor’s alleged conduct with
other women only as a way to determine whether they entirely believed his testimony.
Filner agreed that he had stated in the
past that he never harassed anyone. He also acknowledged that some behavior
described by the attorney would or could be violations of San Diego's sexual
harassment policies. He said during his time in office, he fired some
employees, but stopped short of agreeing with Corrales' contention that staff
members did not come to him with complaints because they were too intimidated.
He testified that some employees did think he would yell at them.
When asked how he felt about pleading
guilty to a felony, he said that the whole experience was incredibly
devastating. He also said earlier in this testimony that it was on his sexual harassment
attorney’s advice that he admitted to the chair and that he did not think he
was guilty of many of the accusations.
It is possible that Filner will be
called to testify later in the trial when witnesses are called by defense legal
representatives.
How
to file a sexual harassment complaint
Under state and federal laws, sexual
harassment in the workplace is illegal. The typical procedure for filing a
sexual harassment claim is:
- First, you should review company policies. There should be mechanisms set in place by your employer that allow you to make a complaint through your company’s human resources department.
- If the problem is still not solved, you may need to file with the EEOC or any other government administration agency. Your claim will be investigated by the agency and action may be taken with your employer to provide for your remedy.
- If the situation is still not resolved, you may have to file a lawsuit in civil court. You will be required to provide evidence, such as written statements or witness testimony, to support your claim.
In most states, you are required by law
to “exhaust the possible remedies” before you can file a lawsuit. In particular, you are usually required to
file with a government agency before you are allowed to file a private lawsuit.
Thus, it is important for you to be
prepared to take various steps in connection with your sexual
harassment claim.
