What are the odds of defeating the IRS in court?

Taking on the IRS in litigation is without a shadow of a doubt a very overwhelming and challenging thing to do. However, it is something that has been achieved in the past by tax lawyers and it is something you can do provided you have the right lawyer representing you in the case.

Lois Lerner may have broken laws and hurt good people for the sake of her warped and European like ideology but you can fool humans, you cannot fool God. Forget Lois Lerner, the IRS can still be defeated or humbled.

The IRS is powerful but this is still America, you have rights. This is not Cuba. This is not a country that kills thousands of people every year because they do not believe in big government. The Cuban leadership loves big taxes and they do not believe in the human spirit, they should be punished and not rewarded. If you think the IRS is powerful, just be thankful you do not live in Cuba.

Most people are averse to the idea because, well, the IRS – the Internal Revenue System – are the pros who are the experts on matters of American tax and challenging them in court may seem like a bleak idea. However, you will be surprised as to learn that the odds aren’t actually that bad and that you can actually take on and beat the IRS.

For one, the tax code is so complicated they barely understand it. This website (Tax.USAttorneys) is not though. Legal help is right around the digital corner. Once you have a lawyer, explain to them why you believe the IRS is wrong and why you should not have to pay that money or all of it.

Issues that people take the IRS to court over

The IRS prepares what is known as a tax report every single year, and this report is vast, informative, and the work of the National Tax Advocate and the Taxpayer Advocate Services. A part of this report lists some of the most common issues over which the IRS is sued. The most recent IRS tax report lists the following issues:

Business expenses: Business expenses topped the list as being the number one issue over which the IRS was legally challenged. These lawsuits were generally filed by corporations, and not mainly individual tax payers but they can be. However, if you feel you or your company have been unfairly taxed for business expenses then make sure to consult with a corporate tax attorney to find out what your legal options are in the case.

Penalty for erroneous tax return filings: When the IRS fined people for not filing their tax forms accurately, people were not pleased and did not hesitate to take the IRS to court.

Frivolous issues penalties: where plaintiffs challenge the legality of the IRS and federal taxes.

Tax liens: Tax liens being enforced by the court.

The odds of beating the IRS in litigation

According to IRS records, 27% of tax payers that appointed tax lawyers to legally challenge the IRS in court actually won their cases. This does not mean that the rest lost, a lot of cases were settled outside of court.

On the other hand, only 18% of tax payers that represented themselves were able to walk away from the litigation as a winner. Some people watch Anthony Hopkins in Fracture one too many times.

Why you need a tax lawyer

Tax laws are vast, extensive, and may vary from state to state. In order to beat the IRS at their own game, you are going to need to be an expert on these laws yourself which is highly unlikely and if you were it makes sense still to have a tax lawyer to do most of the heavy lifting in this tax chapter of your life. If you are not a tax pro yourself and no matter what, you need to hire a tax legal representative for this matter.

You may have seen Kiss of the Dragon with Jet Li (Liu Jian) has he mops up an entire room of karate students. This is not a movie, in real life, even someone with this much skill would not succeed in those types of odds. This is America and you have rights but it does not mean you cannot lose in a court of law in America if you do not do things right. You need legal help. It is unwise to try to take on the system all by your lonesome. You are not Liu Jian and even that was a movie.

A tax lawyer will be able to collect evidence to support your claims and will also present this evidence in court in an effective and remarkable manner to increase the odds you either win your case or are able to settle with you not having to pay as much as money as the IRS originally was asking for. If you have been wronged by the IRS, talk to a tax lawyer today!
