Bronx Man Freed after Serving 20 Years

Richard Rosario was finally able to walk out of a courthouse as a free man for the first time in two decades, and had a teary reunion with his family and a pat on the back by his criminal defense lawyer, as reported by NBC News.

Rosario claims that he has been falsely imprisoned for 20 years for a felony that he never committed. He was released from custody after it was concluded by Bronx DA Darcel Clark that Richard had indeed not received a fair trial and should be set free. However, the charges against Rosario were not dropped, and he still faces a possible retrial while the case continues to be investigated by the DA’s office.

As Robert Torres, the Bronx State Supreme Court Justice, announced his decision, there was applause in the courtroom.

Rosario served 20 years of a 25-to-life sentence for the murder of George Collazo in the Bronx in 1996. He insists that at the time of the crime, he was over 1,000 miles away in Florida. Rosario's story is backed by at least 13 alibi witnesses, among them a pastor, a sheriff's deputy, and a federal correctional officer.

So what is the issue? Why was he in prison in the first place?

The case has been called an illustration of how difficult it is to fight a guilty verdict by Rosario's criminal defense attorneys. For many years, the former Bronx DA stood steadfast regarding the conviction. But when Clark took office in January, she began investigating the case and recently sent investigators to Florida to interview some of the alibi witnesses.

I guess they never heard of a Skype video conference. It is free! Apparently the state of New York is not broke enough.

Did all these alibi witnesses speak up in 96 – did his criminal defense lawyer at the time get them involved? If so, how was Rosario ever convicted?
