Accused Pleads Not Guilty in Deadly Augusta Accident Case

As reported by wrdw.com, Jose L. Roja has been indicted after he was charged with first degree vehicular homicide, driving without a valid license and DUI. Roja was involved in a drunk driving crash when his vehicle landed in an Augusta canal killing one of his passengers.

His bond was set at $100,000. He is not permitted not to leave the states of Georgia and South Carolina and cannot contact the victims – even though they are probably his friends or used to be. He pleaded not guilty to the charges. Augusta, GA drunk driving accident lawyers proclaim that first degree vehicular homicide is a felony offense in the state which can attract a prison term of 3 to 15 years or 5 to 20 years for habitual offenders.

Georgia Woman Sentenced for 2012 DUI

Timesfreepress.com reports that a 25 year old Georgia woman was sentenced to a year of good behavior by a Hamilton county judge. However, the accused is Jessica Leigh Meyer who is a resident of Lilburn, Georgia can appeal against the verdict within two weeks. Over three and a half years ago she was pulled over by the police on Amnicola Highway for suspected DUI where toxicology reports indicated a BAC higher than the legal limit of .08%.

Meyer’s drunk driving accident legal professional said that if she decides to accept the verdict she will have to spend 48 hours at the Silverdale Detention Center and take part in community service for 3 days. She was also fined $500 and will also have to pay court fees while her license has also been revoked for a year. Pretty harsh sentence for a first time offender but she refused to pull over when she heard sirens, did not cooperate with police, has credibility issues, and so on.

If she just plead guilty a couple of years ago this would probably be all over with.

Police Testimonial

Police officers said that they spotted a 2008 Volkswagen Jetta hitting the curb multiple times following which the driver jumped the double yellow line, slowed the vehicle to 30mph, and then accelerated back to 50mph. Records indicate that the vehicle stopped near the emergency service center of the police department on Amnicola Highway. This was Meyer driving.

Officers Brian Blumenberg and Jonathan Totherow testified at the trial. Blumenberg identified Meyer as the driver. He said that he had detected alcohol on her breadth but when she was asked by the officer if she had been drinking, she denied vehemently. She did not want to take a blood test. She also asked the officer if she could leave with a warning. She was arrested on Jan. 16th, 2013 and a grand jury charged her with a DUI, impeding traffic, and failure to maintain a lane.

Davis said that his client was visiting a friend Monica Lindsey. They had dinner together and then Meyer and Lindsey went pub hopping where she had a few drinks for two to three hours and she was driving back home when the DUI happened.

Davis was successful in dismissing the traffic charge but other two charges were considered. It seems Davis worked some magic.

It is just smart not to drive drunk – then you do not have to pay a lawyer to spin their legal magic for you and you will still be charged with something as just happened to Meyer. Why not just sleep a few hours in your car before you go home?

DUI Laws Georgia

Augusta, GA drunk driving accident lawyers want everyone to know that driving with a BAC of .08% or higher is a criminal offence where drivers are liable to be charged with a DUI.
