Man Accused of Drunk Driving in Fatal Accident, Bail Set at $1 Million

A man who was allegedly driving under the influence when he caused a car accident in Mira Mesa which led to the death of a 19 year old female motorist has entered a not guilty plea after prosecuting lawyers charged him with gross vehicular manslaughter while intoxicated and DUI causing injury, as reported by Fox News.

In addition to these criminal charges, San Diego, CA drunk driving accident lawyers point out that defendant can also be held liable in a wrongful death lawsuit filed by the victim’s family who also have recourse to an accident insurance claim.

The suspect has been identified as 21 year old Christian Evangelista who has been released in lieu of $1 million bail. According to the prosecution, Evangelista and his friends were drinking on the night of the car accident when they ran out of alcohol. Evangelista decided to drive to a 7-Eleven to pick up more alcohol despite another friend offering to drive.

Not smart Christian Evangelista!

Defendant was also Speeding and Ran a Red Light

The crash occurred on the way back when Evangelista, as per police records, was doing 55 mph in a 25 mph zone. He failed to yield to a red light and t-boned another car driven by the 19 year old victim Tutam Le.

Emergency medical technicians that responded to the crash attempted to rush Le to the hospital, but unfortunately, Le died on the way there. Evangelista and two other occupants of his car were injured. Christian Evangelista was driving far too fast and chose not to listen to his high school teachers since they certainly told them not to drink and drive more than once.

Evangelista's blood alcohol content was only measured two hours after the collision and he still returned a result of 0.13% BAC which means that his blood alcohol content at the time of the accident could have been anywhere around 0.16% and 0.17% BAC which is twice the legal limit of 0.08% BAC in the state, say California drunk driving accident attorneys.

Evangelista has been on the wrong side of the traffic laws in the past too and has one speeding ticket and one for texting while driving conviction on his record as well.

If convicted, Evangelista could be slapped with a prison term of 15 years and four months, according to San Diego, GA drunk driving accident lawyers who can be reached using this user friendly website Drunk-Driving-Accident.USAttorneys
