What elements play a major role in a DUI bust?

What every Driver must Know about a DUI Arrest

(Mobile, AL) – April 5th, 2016 – For the most part, there is a pattern that law enforcement officers follow during DUI busts. The important thing for drivers suspected of a DUI is to understand the sequence of procedures that are followed so that they know what to expect when they are pulled over by a police officer. They will also have a fair idea as to how they must react under the circumstances.

The Stop

Law enforcement officers ask drivers who show signs of impairment such as erratic driving, swerving, weaving through lanes etc. to pull over. DUI lawyers in Mobile, AL point out that as long as the officers have reason to believe that you were violating a traffic law, they have the right to ask you to pull over. In other words, the officer must have a probable cause to make such a demand.

If you saw the way the villain was riding in the movie Ride Along in the beginning then you will know what noticeable driving looks like. This villain was captured by Ice Cube or James Payton for good reason. He was clearly a criminal and that type of driving needs to be countered with a civic and moral lesson – one that Payton delivered.

Here is the lesson we are trying to deliver. If you need legal help, go right here: DUI-USAttorneys.com. This site is a winner and a life saver. Contact us if you want as well. We may get back to you that same day.

Observations made after the Stop

Once you pull over you will be asked to produce registration and license. During this time, the officer will observe you closely. For instance, if you fumble to produce the paperwork, have the odor of alcohol on your breath or if your speech is slurred, then the officer will assume you are intoxicated.

The officer will then ask you to step out of the vehicle. This is a clear indication that the officer suspects alcohol-impairment. Therefore, it is important to act carefully because your demeanor will be detailed in the police report and can be used against you, caution Alabama DUI attorneys.

What happens during the Inquisition?

The investigating officers will ask you a series of questions. They will definitely ask if you had anything to drink and they are not referring so soda or some water! You may deny or say that you had a glass of wine with lunch but as soon as you lie the officers will note that in their official report. Most importantly, seasoned officers will know when you are lying.

In addition, if your DUI case goes to trial and you truthfully tell the jury that you actually had 4 or 5 drinks then the prosecutor will use the police report to paint a bad picture. Lying is never impressive. You can ask the psychiatrist that in the show The Sopranos who covered up a rape to Tony Soprano. Dr. Jennifer Melfi knew that Tony would kill this person but so what? Is that not what a rapist like that deserves? Either way, do not lie to the police – if you do and they find out which they probably will, you will have lost all credibility.

When does the officer search your car?

Your car will be searched if the police believe that you have an open container of alcohol or drug paraphernalia. Usually the entire car is thoroughly searched including the trunk and the glove compartment. Before commencing the search the police may ask you to give consent for the search. If you consent, remember you will not be able to challenge the evidence gathered in the search later. If you do not give consent the officers can get a warrant in which case you cannot intervene or they might choose to conduct the search without the warrant. In the latter scenario the evidence collected during the search can be deemed inadmissible by your DUI legal counselor in a trial.

Roadside Sobriety Tests

According to Mobile, AL DUI lawyers, you may be required to take a PAS test or a Preliminary Alcohol Screening. This is done through a calibrated machine that is used to measure percentage of alcohol in your breath. There are several types of sobriety tests where you may be asked to walk heel to toe in a single line or the officer may conduct the horizontal nystagmus test where you are asked to move your eyes following the flash light and so on.

There are also certain mandatory chemical tests such as blood and urine tests you may be required to submit to after your DUI arrest.

Make sure to call a DUI lawyer in Alabama as soon as you believe that you are about to be arrested and charged for a DUI violation. Driving under impairment is a very serious offense and you are looking at some jail time, fines, and other penalties. Most often than not, the police report is the only evidence they have against you. So speak to a legal pro as soon as possible before answering any possibly incriminating questions.
