Law enforcement officers are currently
investigating how a truck accident occurred and what exactly
caused a truck to overturn in Fonde Mountain, near Middlesboro. As reported by harlandaily.com, the Kentucky State Police
Commercial Vehicle Enforcement said that the accident occurred close to noon
but was not reported as an emergency to 911 until later in the day at around 4
pm.
Truck
Driver Flees Scene of Accident
The truck is owned by Lemar Trucking
Company Inc. a company based out of Morris Lane in Harlan. The report details
that the truck was filled with coal and toppled over while the driver was
maneuvering a curve on the mountain. Furthermore, once the truck toppled on its
side, the driver got out and was nowhere to be found when law enforcement and other
authorities arrived.
Upon interrogation, they were told that
the driver had left the scene to go to a hospital to receive treatment for his
injuries. However, when authorities checked the hospital that he apparently had
gone to, they figured that he had never showed up there at all and had instead
fled. According to Louisville, KY truck accident lawyers, fleeing the scene of
an accident is in violation of the law, which can only add to the charges filed
against the driver and/or trucking company.
Does this driver think he can hide? It
is very easy to find out who you are!
Driver
did not Hold Commercial Driving License
Police confirm that they have been able
to acquire the truck driver’s identity and charges are pending against him.
Prosecutors are also going to charge the trucking company itself for hiring and
letting a truck driver operate who is not qualified and did not hold a
commercial driving license.
Kentucky truck accident attorney
reiterate that it is the trucking company’s duty to conduct background checks
and ensure that their drivers are properly qualified. If not, they can be held
liable in a truck accident insurance claim and any
personal injury or wrongful death lawsuit.

Lemar Trucking Company Inc. made a big
mistake. Taxes are high and companies are trying to save money but this is not the way you do it.
Overloading,
Potential Cause of Accident
Upon further investigation, police also
found that the legal load limit and total all up weight of the truck was in
excess of what was allowed by both the state specific trucking laws and the
federal trucking laws enforced by the Federal Motor Safety Carrier
Administration. Louisville, KY truck accident lawyers confirm that overloading
is one of the major causes of fatal accidents.
Investigators who checked the safety
record of Lemar Trucking Inc. have discovered that this is not the first time
they have been negligent and violated safety standards. Previously, a truck
belonging to the same company was involved in a fatal accident on US Highway
119 in which two other vehicles were also involved and the accident claimed the
lives of two people.
