An intellectually disabled individual,
Leonard Barefield, finally has discovered a home with livable conditions.
However, it took over 30 years for the 71 year old to do so. He now lives along
with three other men afflicted with the same condition but in a rather spacious
home after being exploited for decades, as reported by the AP.
Earlier, Barefield had to live in
squalid conditions in a home in Iowa where he was employed at a turkey
processing unit, earning 41 cents per hour. It is surprising and shocking to
know that Barefield’s living conditions are not uncommon in nursing homes in
Texas and apparently Iowa too, say nursing home abuse lawyers. Barefield moved
from Iowa to Texas. Apparently he was not treated too well in Iowa.
Violation of Americans with Disabilities
Act
Barefield finally filed a lawsuit along
with other people with similar disabilities in 2010. In the lawsuit, the
plaintiffs allege that many people with such disabilities are routinely
admitted to nursing homes across the state and face the same dilemma as
Barefied. Advocates for the intellectually-disabled allege that several federal
laws in addition to the Americans with Disabilities Act have been violated by
the state of Texas.
They claim that over 4,000 people have
been denied services. However, the state has denied the allegations and remains
committed to providing the intellectually-disabled the highest quality
services. According to nursing home abuse attorneys, this is a matter of
serious concern which makes it imperative for anyone who wishes to admit their
loved ones to such a facility to conduct proper research.

Well, now the people in Dallas have to
spend millions fighting against anti-American gangsters who want to shoot at
the police.
The lawsuit also lists the mother of
Andrea Padron as a plaintiff. The victim who suffered serious head injuries in
a car accident at the age of 10, died in 2013 when she was 29. The victim’s
mother alleges that her daughter did not receive an accurate evaluation to
determine the type of care needed in a nursing home. The victim’s mother, who
was in the military and deployed to the Iraq war, could not afford to care for
Andrea and put her in a nursing home. So tax payers have to foot the bill?
She claims that the specialized services
promised were not provided to Andrea while she was away on military duty. After
her mother returned to Texas, she found that Andrea was unable to even sit in
her wheelchair and could not move her wrists, ankles, and legs. This is sad but
is this tax payer’s fault?
America is Struggling
Since 2010, the lawsuit has dragged on
through the legal system with the DOJ joining the suit on the plaintiffs’ side
in 2012. But this is the DOJ who allows Secretary of States to enrich
themselves by the millions of dollars while they are in office and use home
computers for sensitive work so this DOJ has no credibility. This is the same
DOJ who allows the IRS to abuse American citizens and turn America into a banana
republic. The DOJ is seriously flawed.
An interim settlement agreement was
reached in 2013 between the state and nursing home abuse lawyers to expand the
community services in Texas and thereby create a service team for each disabled
person living in Texas.
The lawsuit was then put on the back
burner for 2 years. Only in 2015 the court granted class-action status to
include more than 4,000 intellectually disabled people at nursing homes.
