New Jersey Supreme Court Overturns $2.7 Million Truck Accident Award

The New Jersey Supreme Court recently overturned an award of $2.7 million issued to a Hackensack woman for an accident claim. The award stemmed from an accident in which the woman’s car rear ended a garbage truck. According to a report by the New Jersey Law Journal, Justice Anne Patterson observed that the defendants were deprived of a fair trial on liability or damages issues due to a series of errors made during the trial.

According to Trenton, NJ truck accident lawyers following the case, the plaintiff, Sofia Torres, who was 21 at the time of the accident on August 30th, 2007, rear ended the garbage truck while driving east on Route 46 in Fairfield. She alleged that she could not see the truck’s lower rear lights due to dirt and mud.

If you not paying attention to your driving and you rear end someone, it is your fault.
However, Suburban Disposal Inc, the defendants along with the truck driver, Javier Pabon, argued that the upper lights were visible and therefore Torres was at fault. The plaintiff claimed she suffered injuries to her right kneecap, ankle, and foot and also damaged a nerve in her right arm due to which she spent six days in a coma.

Was Sofia Torres tailgating?

The judge who reversed the verdict citing an unresolved evidentiary dispute has now granted a new trial. When you rear end someone, it is normally your fault.
