Motorist gets 13 Years for Fatal DUI Crash that Killed Two

22 year old Shane Gerald McDonald finds himself having to spend 13 years and 8 months in state prison by Superior Court Judge Kenneth So after causing a fatal drunk driving accident in which two members of a family of five were killed.


As reported by KFMB, the defendant pleaded guilty in April to gross vehicular DUI manslaughter and DUI causing great bodily injury. According to San Diego, CA DUI lawyers, this type of sentence was expected considering the seriousness of the crime. Some people believe he should have been sent away for 20 years.

The accident occurred last year on May 2nd. McDonald was speeding in a black Audi in the early hours of the morning south of Mercy Road on an I-15 express lane when he collided with a Honda sedan carrying five passengers. 84 year old Teresa Esparza Hernandez and 55 year old Rodolfo de la Torre were killed, according to the California Highway Patrol. Three passengers in the back seat sustained major injuries. The family was on their way to attend a wedding in Mexico and was heading for the airport when the fatal accident occurred.

Monica Arizzon, stepdaughter of Teresa Hernandez, urged the defendant to make better choices. McDonald appeared remorseful and apologized to the victims’ family. Gavin Loy, a witness to the accident, testified that he saw McDonald driving in the wrong direction and causing the head on collision. Loy also said that the defendant smelled of alcohol and attempted to run away but was urged to sit down.
