Law Makers in Texas Contemplate Wrongful Birth Law

We have all heard of wrongful death lawsuits, but soon we may also become familiar with a wrongful birth law say outstanding hospital neglect or medical malpractice lawyers in Dallas, TX. As reported by texasobserver.org, the drafting of such legislation will be brought to the forefront of the 2016 legislative assembly thanks to a medical malpractice claim that has taken a turn and wandered to a gray area of the current laws.

Wrongful birth claims, if passed in the assembly as a new form of claim, will essentially enable parents of children born with severe defects to sue doctors for malpractice or other health care professionals or organizations such as hospital for neglect. Victims have the right to sue for economic, non-economic, and punitive damages say medical malpractice lawyers in northeast Texas.

Of course like any other lawsuit, the burden of proof will remain on the plaintiff or the parents in this case and they will be required to prove that the defendant was negligent and that this negligence resulted directly or indirectly in their baby being born with such severe defects. Those that are able to emerge victorious in malpractice or hospital neglect lawsuits will essentially be awarded monetary damages which will be sufficient for them to support their disabled child’s healthcare and other expenses for throughout the child’s lifetime.

The list of interim changes to include wrongful birth law

The law is already in the list that was compiled by Lieutenant Governor Dan Patrick, and the list is called the list of interim changes. It, as the name suggests, includes a list of potential law enhancements\amendments that law makers will consider prior to their next meeting in January of 2016.

According to the director of the Texas State Medical Board, there are no clear statistics or records of such wrongful birth cases in Texas. However, the board has in recent years scrutinized as many as five such claims. The director also said that anti-abortion supporters are eager to criticize and deny the need for such wrongful birth laws.

The director of the anti-abortion organization known as Texas Alliance for Life, Mr. Joe Pojman, expressed his views in saying that the passage of such a wrongful birth law would essentially propagate the message to parents and other people alike that the child would have been better served if aborted.

If the wrongful death claim law actually be passed or not is something even the best medical malpractice attorneys in Dallas TX do not have the answer to so it looks like we can only wait and see.

Michael Messengale claims Judge Lehrmann is a court outlier

Judge Michael Messengale and Judge Debra Lehrmann are both Judges on the Texas Supreme Courts’ Judges panel, but it has emerged that things between the two of them are a little a shaky as Messngale has recently come out saying that more often than not, Lehrmann purposefully disagrees with the views of Messengale solely because they are his views, as reported by news-journal.com.

How much truth there is to this claim? And what will transpire next between the two? Only time will find out.

If you or a loved one is a victim of medical malpractice or hospital neglect, you have legal options to recover damages. Make sure to speak with a north central Texas medical malpractice lawyer as soon as possible since medical malpractice claims are bound by a statute of limitations.
