House Arrest for Broward County Judge Following DUI Charge

Broward County Judge Cynthia Imperato was put under house arrest for 20 days when she was apprehended by the police in Boca Raton while driving under influence in 2013. During this encounter she refused to cooperate with the police for which she was found guilty. Following the incident the State Supreme Court initiated disciplinary action against the judge.

The latest bid by the judge to cut a deal that will involve a fine and a suspension was rejected and this means she will have to resign by February end, as reported by wsvn.com. Fort Lauderdale, DUI lawyers such as Leader & Leader, P.A. know the state has adopted the implied consent law where drivers consent to submitting to breath, blood, or urine tests if they are pulled over for suspicion of a DUI.

Remember, driving is a privilege, it is not a right. Your driving privileges can be revoked.

Terminal Cancer Patient Gets Jail for Violating Parole

Sabrina Orbera, who is terminally sick due to stage 4 liver cancer, will return to prison for a parole violation. She was serving a prison term of 15 years from 2006 after she pleaded guilty to DUI manslaughter following an accident in northwest Orange County in which Michelle Farrulla who was then just 38 years old was killed. However, she was granted parole recently due to her medical condition by the Florida Commission which looks into offender reviews, according to orlandosentinel.com.

On Feb 3rd she was rearrested for a parole violation and the commission has ordered her to return to prison rejecting her request to allow her to stay at her home during her parole review period which can take up to 2 months. The doctors have given her 6 months to live.

Her DUI legal representative Jim Lewis said that the decision by the commission is ‘inhuman’ since she is a dying woman. But a dying woman can still get into a car and kill someone else right?

Orbera in a statement said that even if she did her full term of 15 years it would not bring the victim back. If that is the behavior then why put anyone in prison at all? DUI attorneys in Fort Lauderdale, FL and one of the best in this area of law is Leader & Leader, P.A. in this part of Florida are on the same page in terms of the fact that DUI manslaughter is a second degree felony that attracts a sentence of 15 years imprisonment and not less than $10,000 in fines.

The parole violation happened when Orbera had an altercation with her daughter at their family residence. The incident happened over an argument regarding tax issues for which her daughter wanted to call the police but as she picked the receiver up Orbera pulled her daughter’s hair apparently to dissuade her from taking that step. In the fight that ensued she grabbed her daughter and they both fell on the bed.

Even though it is unclear who started the fight Orbera claimed that she was only trying to prevent daughter from hurting her grandmother whom she punched. Later domestic violence case was brought against her by her daughter and she was arrested. Orbera said that the altercation was just a result of adjustment issues which they have between them since they had lived apart for almost a decade.

Lewis is trying to convince Orange-Osceola State Attorney’s office not to press charges in the domestic violence case. Even though a spokeswoman of Orange County Jail said that they will provide all possible care and treatment to Orbera, Lewis doubts the quality of care she would receive in a jail. He says that all she wants it to spend her final days with her family and she is just pleading with the justice system to make it happen. But does her family want her at home?

Many people believe it does not matter where Orbera stays since she is going to pass away anyway and not one Fort Lauderdale, FL DUI lawyer can do anything about that right? Prison seems like it is the best place since it seems that Orbera is always in trouble when she is not in prison. Some people cannot be trusted with freedom.
