Laws on Practicing without a Medical License

According to the Palm Beach County Sheriff’s Office, 18-year old Malachi Love-Robinson was arrested and charged with practicing medicine without a license on February 16th, 2016. He watched Catch Me if You Can a little too much! This is complete hospital neglect – in a strange way though.

He thought he was Frank Abagnale, Jr.! Leonardo DiCaprio, your acting is exceptional, perhaps too good! Some immoral young Americans want to be like you in that movie!

After receiving a complaint the first week of February, the investigation was started by the department’s Narcotics Task Force and the Florida Department of Health. The investigation “revealed that Love-Robinson had opened a medical office… and was presenting himself as a certified medical doctor.” Wow, why not be a medical malpractice lawyer as well?!


An undercover operation took place during the investigation. Police say Love-Robinson was immediately arrested after performing a physical exam on an undercover agent as well as offering medical advice. He was also accused of impersonating a doctor last January at St. Mary’s Medical Center. However, St. Mary’s denied that Love-Robinson came in contact with patients and did not press charges against the teenager. The police at the time decided that he had not committed a crime.
Apparently he was just bored! That is how bad this economy is because of high taxes and regulations, there is not enough real jobs in America, people have to make up jobs!  

However, the Palm Beach County Sheriff's Office reported that in October 2015, the Department of Health investigated and cited Love-Robinson for practicing medicine without a license.

No Office!

On Wednesday, Love-Robinson was relapsed from jail on $21,000 bail. He had a short phone call with CNN and declined to be interviewed – perhaps because he did not trust that network. However, he did say that he would present a statement outside his office (his office! – is he delusional?! – he must be like Al Gore who said he invented the Internet or the current president who told us that his health care act would not separate us from our doctors or raise our medical costs) and would have a legal representative with him.

Love-Robinson does not have an office, he does have a jail cell though for this clear but strange form of hospital neglect.

Practicing without a License

For some occupations, licensure is required before people can practice in that profession. Many professions require a license, including doctors, lawyers, pharmacists, engineers, veterinarians, accountants, real estate agent, nurses, social workers, etc. “Practicing without a license” is a crime committed by anyone who engages in a profession without having a proper license. How come someone did not inform Love-Robinson this? Now he needs a medical malpractice attorney or a criminal defense legal representative. 

Practicing Medicine

When a state has requirements for a license to practice an occupation, the term “practicing” refers to services that are performed for someone else. Certain professions require licenses in order to protect the public by ensuring that these occupations are handled by people who are capable of providing the intended service. For example, doctors treat people for injuries and illnesses, and without the proper education, training and expertise, they could cause harm to their patients.

When it comes to the practice of medicine, different states have different definitions of what it means. Regardless, medical professionals in all states are required to obtain some kind of license before being able to engage in their occupation. This includes doctors, nurses, dentists, veterinarians, and other healthcare professionals. Typically, the definition of practicing medicine in all states is any activity intended to cure disease or preserve health. However, activities such as selling vitamins, selling home remedies, providing general advice, providing books on nutrition or healing or other related activities is not included in this broad definition.

If a person diagnoses people, performs physical examinations, or prescribes medication, it is an activity that is covered by the unauthorized practice of medicine. It is often a felony offense to practice medicine without a license and it is unethical! Did Love-Robinson just need some attention? He should have played sports in high school and excelled in one of them if he wanted some attention. Go practice a jump shot! Or get a job (a real job, the White House has not destroyed them all) and work hard somewhere. How did he not think he was going to get caught? What did he say to fool so many people?
