Judge, Yet Again, does Not Dismiss Property Tax Lawsuit Filed Against University

A tax court judge in New Jersey has started to raise a few eye brows after he, for the third time, rejected a plea by the defendants to have a lawsuit against them dismissed. The lawsuit was filed by three New Jersey citizens which essentially claims that Princeton University should not be exempt from paying tax, as reported by centraljersey.com.

Judge Vito L. Bianco had previously denied two requests that the lawsuit be dismissed and tax lawyers are following the story for a variety of reasons.

For their third attempt at getting the case dismissed the defendants in the lawsuit argued that legal technicalities and other details of the case should have been considered in front of the Mercer County Tax Board and not the New Jersey Tax Court. What is really hilarious is that academics are mainly pro-tax, they love big government and higher taxes. And their employer does not want to pay any taxes at all? Can someone say hypocrisy?

The tax attorney representing the plaintiffs in the case spoke to media personnel and commented that the attempt to have the lawsuit dismissed was a weak and desperate last ditch effort from Nassau Hall. He also went on to confirm that once the judge declined to dismiss the lawsuit, the school’s legal counsel contacted him to discuss and negotiate a potential settlement offer.

If the lawsuit is not settled out of court, then it will be going to back to the court room for trial and the same judge that declined the three dismissal attempts will be assigned to it.


Even though the judge did not dismiss this Princeton lawsuit, it looks like he did consider the request of the school asking that the plaintiff’s provide a list of the particular properties being challenged in the case. The judge has instructed the plaintiff’s to provide this list within 30 days failing which the case will be dismissed.

The defendants are Delta Air Lines, United Airlines, and American Airlines and all three of these companies are finally doing well because of low fuel prices. This industry had deal with serious union pain which even caused some airline companies to fail and high taxes never helped either but now these companies can actually sleep better now. But now they need to wake up since someone is pointing the finger at them. 

The allegation against them is that even though certain passengers were exempt from paying the $20 to $25 Mexican tourism fee which is levied by the Mexican government which makes no sense but that is another story, the airlines, nevertheless, forced passengers to pay this tax and chose to keep the money for themselves, according to a Jacksonville.com report.

The lawsuit further alleges that this practice has been going on for nearly one and half decades and that the airlines continue to solicit money from their passengers in this fashion probably to offset the high fuel costs because America for years did not know how to harness its oil shale like it does now which meant high gas prices were the norm since America had to rely too much on Middle Eastern oil. These high fuel prices were killing the airline companies but that is not reason to manipulate tax fees of your passengers. Tax lawyers representing the airlines refrained from making any comments.

The case will go to trial and be heard in the federal court of Brunswick.
