For the most part,
parents of US citizens can attain green cards without having to cross that many
borders (pun intended). To apply
on behalf of your parents you must be at least 21 years of age. Since
parents are referred to as immediate relatives they are not subjected to yearly
LPR quotas.
You will however have
to provide proof to the authorities that you have sufficient income to support
your parents. America has enough people on welfare but in the current
administration, paying people for votes is not a big deal at all so coming here
and not being able to support yourself may not be a big deal depending who is
in office. Basically you must show that your parents will not need financial
aid from the government (one that is $19 trillion in debt now and continues to
grow higher as if being in debt does not have financial repercussions) to
survive and you earn enough to look after your family as well as your parents.
There are some grounds
under which they might be considered inadmissible as green card candidates.
They will be barred if they have been convicted of a crime, violated immigration laws, or pose a public threat, for example, as if they were
carriers of a contagious disease. Since the process entails various formalities
an immigration lawyer can be of righteous help right from the initial stages in
the application process.
In fact, you should not
do anything without legal assistance. You could set yourself back and your
parent’s chances.
Application Process
You will need to use
Form I-130, which is called the petition for alien relative, from the USCIS
website. In the petition you must prove that you are a US citizen and that have
you a parent-child relationship with the individuals.
The documents that must
be attached with your petition are a copy of your naturalization document, your
US passport, along with your birth certificate that has your birth details and
the names and details of your parents. If you want both your parents to obtain
LPR status then you will have to file two I-130 petitions separately. It would
be prudent to have these petitions checked by an immigration attorney.
Once the visa petition is
approved, the files will be forwarded to the US consulate of your home country
who will then contact your parents to fulfill certain formalities. This will
include an interview at the consulate. During this time you will have to submit
Form 1-864 which is an affidavit of support.
What happens if your parents are already living in the US?
If your parents have
entered the US with a legal permit then they do not need to leave the US to get
an LPR status. However, if they are in the country as illegal immigrants then
it might threaten the prospects of acquiring a green card especially if they
have stayed in the US illegally for more than 6 months. This is a serious offense
and they might be considered inadmissible by law. If such is the case consult
an immigration lawyer to see if there is a way out.
Do not try to cheat the
system like Danny Glover’s Det. Murtaugh did in the goofy movie Lethal Weapon 4
(Jet Li was the only decent character). And do not try to pile in some children
from another family in your own kids’ bedrooms and act like your children will
be OK with that like the children were in Lethal Weapon 4 which made this
scenario even more preposterous. Sorry, a detective cannot support 11 people,
no way, no how. This is fantasy world!
US authorities expect
that your parents will make the US your permanent home. This means that they
must notify the authorities if they remain outside the country for a length of
6 months or more as their green card can be revoked when they try to re-enter
the US after this length of time.
Since immigration law
is complex with plenty of paperwork and steps involved, it would be sagacious
to engage the services of an immigration lawyer if you wish to bring any relatives
or your parents into the United States or require a change of immigration
status. Your legal representative will help streamline the process and make
sure you submit your application without any errors.
A Website for the Ages
They say there is
nothing free in this world – that is not entirely true. Well, someone has to
pay for the Internet but those costs have fallen and you can obtain Internet
access at a Starbucks or a supermarket if you just make any purchase. You could
use their Internet for free but that is not ethical and so on.
You need to go right
here: Immigration.USAttorneys. Finding legal help is all but free for all intensive purposes
and your immigration dreams can become a reality. This website was built for
you and we ask nothing in return. And unlike websites the White House makes, it
actually works and does not hurt other Americans but that is another topic. How
about that for nobility and honor!?
Any questions, contact us. We wish
you the best of luck and hope you and your family are legally united soon.
