High Court of New Mexico Set to Tackle Highly Debated Workers Compensation Question

Not too long after a lower court in New Mexico (NM) ruled in a case which essentially paved the way for farms and ranch laborers all across the state to become eligible for worker’s compensation benefits, the High Court of New Mexico will now take a look into the case and review it. An overturning of the ruling or the verdict is not out of the question either, as reported by santafenewmexican.com.

This is because ranchers and farmers cannot afford that. They have probably laid off half their work force because of this new law. If illegal immigrants are paid as much as Americans, why hire illegal immigrants? Most people that work in these New Mexican farms are illegals. This is like thinking that raising the minimum wage is better for workers, the poor, and society. It is not. It kills jobs as proven by so many studies that leftist politicians will always probably ignore. There should not even be a minimum wage according to business savvy folks.

Furthermore, workers compensation lawyers representing the New Mexico Center on Law and Poverty have revealed that they are in the process of filing a motion which will essentially require the high court to at least consider the stay of the ruling made by the NM Court of Appeals.

Gail Evan’s, the legal director of the New Mexico Center on Law and Poverty, has spoken out and expressed his opinions that once the court fully comprehends the true impact that such a ruling has on farm and ranch workers, they may very well just allow the stay to be in effect. But Evan’s initiative is irrational if he cares about jobs for illegal immigrants or Americans. How does making life harder on their employer’s going to increase jobs for illegal immigrants? But, as stated down below, perhaps this can open the door for more Americans and less jobs for illegals.

More benefits and better treatment could bring Americans back into the work we used to do.
If you have been hurt on the job you deserve worker’s comp. If anyone says they do not have any money then it is probably because they are paying people who say they are hurt but are not hurt anymore. Regardless, you are should be paid. Lower court filed petition for high court to consider stay

Workers compensation attorneys that have personally worked with dairy workers and farm workers say they know what these people go through on a daily basis, and they also seem to agree that to deny them of workers compensation benefits would simply be inhumane. But they are paid 3 times as much anyhow working in America than they would be paid if they were in Mexico. In fact, they may not even have a job at all if they remained in Mexico.

They claim they have seen innumerable cases where a farmer or ranch worker has become permanently disabled at work due to an accident and yet they receive no workers compensation and pretty much left to bleed out. No one should be left to bleed out but how about stop paying Americans not to work, secure the southern border, and get Americans to handle these jobs? Why does America pay Americans not to work when there are jobs available? If these jobs are so rough, perhaps no one should do them.


Possible less work for illegal aliens

Workers compensation benefits were first denied to farmers, cow farmers, and ranchers back in the 1930’s when a law was passed that anyone involved in occupations such as growing crops, or trading meat, and dairy would not be allowed to obtain benefits. This is probably why Americans chose not to do this work anymore and only illegals were hired. Well, it looks like more Americans should consider entering this work since there are benefits available. This means more work for Americans which is always a good thing.

Mayor to fire lady who claimed workers comp and is now working elsewhere

Lawrence Mayor Daniel Rivera was supposed to have been on an inspection when he came across a woman named Karen Toto. Toto was seated behind a bench and was working for the dispatch center for a company called Valley Towing even though she had years ago claimed she would never be able to work again and has since collected payments made by the government up until October of 2014. The city pays Toto $996 every 14 days, as reported by Eagle Tribune.

It has become a common practice in recent times where people who are injured at work to claim workers compensation benefits and then a few years down the line they begin to work elsewhere and earn wages while still receiving workers compensation benefits from their workers compensation case. That is immoral and has made worker’s comp a scam. Workers compensation lawyers see this all the time.
