American Employees Ready Themselves to File Lawsuits Following Lay Off

Leo Perroro worked as a technician at World Disney’s Orlando office but unfortunately he was replaced by an immigrant worker who he trained. He lost his job along with 250 other workers who have very little hope of finding alternate employment in the near future because job killing regulations like Obamacare, high taxes, regulations that stifle business, and so on. Therefore, Perroro and another fellow employee Dena Moore have filed a lawsuit against the entertainment giant for unlawful termination, according to The New York Times.

In their lawsuit they claimed that Disney had flouted H1B Visa laws to bring in immigrants to replace them, thereby jeopardizing the livelihoods of American citizens. They have also named two tech companies HCL and Cognizant in the lawsuits for adhering to the same hiring techniques, which according to immigration lawyers is move in the right direction.

Disney is not so Friendly

Like Perrroro, Ms. Deane too was forced to train the person replacing her as a pre-condition that had to be fulfilled for severance. Wow! Incredible! In the lawsuits they claim that outsourcing firms colluded with an American company to replace Americans by immigrants simply because Disney could pay these employees less. Both Perroro and Dean have since their termination applied for several jobs in Disney but were denied employment.

Mickey Mouse is pretty cruel indeed.

Uproar Over Discovery of Similar Terminations

This lawsuit brought to light other incidents where American employees were given termination notices. In these cases too they were made to train immigrants to replace them. Perroro and Moore allege that big outsourcing firms were responsible for the mass sacking of Americans from American firms.

They claim that outsourcing firms like HCL and Cognizant committed visa fraud by submitting multiple applications for a single candidate. Candidates from these companies took about one third of the cap of 85,000 allowed by Congress. This is a federal fraud since multiple visa applications for a single candidate is illegal. Even though immigration attorneys and federal agencies do not condone this practice some companies participate in the fraud openly.

The US Labor Department has commenced investigations into these outsourcing firms as well as American companies such as Disney and South California Edison. Both the companies have laid off hundreds of Americans recently. 30 former Disney employees have complained to the EEOC or the Equal Employment Opportunity Commission that they have faced discrimination as American nationals.

Under H1B Visa rules companies are allowed to employ skilled foreign workers only if no US national with the required skill set has applied or is available. This means that they must not affect the prospects of employment of an American national but this was exactly what had happened. The employers must declare that no US citizen will be adversely affected by the hiring of an immigrant, according to immigration attorneys.

Sara Blackwell representing the employees of Disney says that the companies did not honor this declaration as Americans did get affected and hardworking US citizens have lost their livelihood.

Disney’s Reaction to the Lawsuit

Disney has however vehemently denied these allegations stating that this happened due to gross misrepresentation of facts. They said that about 100 workers whose services were terminated had been hired back by the firm and so there is absolutely no legal basis for this case.
